GENERAL CONDITIONS OF CONTRACT

 

 

These terms and conditions of sale regulate the agreement between Spazio Massages and the client formalized through the website “https://masajecaliforniano.com/” . They are valid for an indefinite period of time and are applicable to all contracts made through this website.

Hereinafter we will refer to it as “Spazio Massages”.

 

On the other hand, the Client, who  is responsible for the veracity of the personal data provided to SPAZIO MASAJES.

OBJECT OF THE CONTRACT

The purpose of this contract is to regulate the contractual relationship between  SPAZIO MASAJES and the Customer when the Customer accepts the corresponding checkbox during the online purchase process. The contractual relationship of purchase and sale involves the specific service in exchange for a specific price and publicly displayed on the website.

PURCHASE PROCEDURE

 

In order to place an order through the Web, the Customer must be of legal age and must be the end customer. Minors are expressly excluded.

How to order through the “Shopping Cart”.

To place an order through the Spazio Massage Web  you must follow these steps:

1. Choose the desired services and add them with the “Add to cart” button .
2. Finalize the purchase by clicking on “Finalize purchase” if the order is complete. 
3. If the customer is not registered , he/she should do so at this time. If you are already registered, you only have to enter your e-mail address and password. 
4. Select the “Preferred Payment Method”.
5. Click on “I have read and agree to the terms and conditions of the website” for order confirmation.
6. To finish, click on “Place order”. A message like this should appear: “Thank you for your order”.
7. At this point the customer’s order is registered and begins to be processed.
8. You will shortly receive an email confirming your purchase.

 

 

AVAILABILITY OF COURSES/WORKSHOPS/EVENTS

Courses/workshops/events are offered, face-to-face or online, whenever available. If a course/workshop or event is not available, or cannot start on the scheduled date, website users will be informed as soon as possible. If there are no places in a particular group of classes, a waiting list will be offered in case there are vacancies. The place may also be reserved for the next available call for applications.

Likewise, the student/client has the right to request a refund of the amount paid, in which case SPAZIO MASAJES will proceed to such refund by bank transfer. In this case, SPAZIO MASAJES will refund, exclusively, the amount that the student/client paid for the purchase of the course/workshop or event, without any obligation on the part of SPAZIO MASAJES to cover any type of expense that may have been incurred in such operation.

FORCE MAJEURE

Neither Party shall be liable for the total or partial breach of its obligations under this contract, if such breach is caused by an event constituting force majeure. Cases of force majeure shall be considered to be those that comply with the criteria established by the jurisprudence of the 2nd Civil Chamber of the Supreme Court. The Party invoking an event constituting force majeure shall give notice thereof to the other Party within five working days following the day on which such act occurred or on which the threat thereof manifested itself. The Parties agree that they shall agree as soon as possible to determine all the modalities of execution of the order when they are faced with a case of force majeure. After the period of one (1) month of interruption due to force majeure, SPAZIO MASAJES may not respect the order and, if necessary, must refund the amount of the order to the buyer.

PARTIAL NULLITY

If one or more provisions of these general terms and conditions of sale should be declared null and void or invalid by virtue of a law, a regulation or a final decision of a judicial body, the other provisions shall remain in full force and legal effect.

PRICE

Course/workshop/event prices are in Euros and include taxes applicable on the day of the order. The price invoiced to the purchaser is the price indicated in the payment confirmation on the website at the end of the registration/enrollment process. If the registration/enrollment is done externally to the website, the price invoiced will be the one indicated via e-mail by SPAZIO MASAJES.

CHANGES IN PAYMENT

SPAZIO MASSAGES reserves the right, which the user accepts, to modify its prices at any time, but the courses/workshops/events will be billed based on the rates in effect at the time of registration/enrollment.

FORMS OF PAYMENT ACCEPTED ON THE WEBSITE

Payments will be made through the Internet. The user will enter the requested data in the secure banking platform. Such data will not be stored in any case in SPAZIO MASAJES. The banking platform will inform SPAZIO MASAJES of the validity of the purchase. Only if the sale is fully confirmed SPAZIO MASAJES will consider the purchase as completed and proceed with the registration/enrollment. SPAZIO MASAJES does not know the reasons for the refusal of the banking platform.

TYPES OF PAYMENT ACCEPTED ON THE WEBSITE:

• Online payment by credit/debit card through our payment gateway
• Payment by PayPal (depending on the geographic location, it will be requested or not to create an account in this payment method) with an added cost, assumable by the buyer.
• Other payment methods, external to the website, are also available. In the case of requesting them, a SPAZIO MASAJES consultant will contact you to arrange it.

 

INCIDENTS AT THE START OF COURSES/WORKSHOPS/EVENTS COURSES/WORKSHOPS/EVENTS

In the event of any incident or delay in the start of the courses/workshops/events, SPAZIO MASAJES undertakes to make the necessary arrangements to expedite the start of the courses/workshops/events.

However, due to the interpersonal nature of our training offer, the student/client acknowledges (and accepts) that the start date of any course may be subject to change. In this case, SPAZIO MASAJES will communicate this to the student/client involved, offering him/her the different alternatives available and proceeding in accordance with the section “Availability of courses/workshops/events” of these terms and conditions.

RIGHT OF REVOCATION AND WITHDRAWAL

From the date of registration/enrollment, the student/client has a period of 14 days (according to the official calendar of his/her home) to withdraw from the contract, with the right to a full refund of the amounts paid, without completing any formality except written communication to SPAZIO MASAJES, and without incurring any penalty. If the above conditions are met, SPAZIO MASAJES will reimburse the purchaser within a maximum period of thirty (30) days the exact amount corresponding to the registration/enrollment fee. However, according to Article 103 of Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users and other laws, provides that contracts that refer to:

“(m)) The supply of digital content that is not provided on a tangible medium where performance has begun with the prior express consent of the consumer and user with the knowledge on his part that he consequently loses his right of withdrawal.”

Therefore, if the course/workshop or event is given online and has started within this period, the buyer acknowledges the loss of the right of withdrawal, given the nature of the product (online course/workshop or event) and the provision of all content to the student/customer. The student/client, therefore, declares that he/she is aware of these particular conditions regarding his/her right of withdrawal and accepts them from the moment he/she gives his/her consent to the purchase of the course/workshop or event.

ENROLLMENT IN COURSES/WORKSHOPS/EVENTS

Enrollment is individual and non-transferable for each person and each course.

DEVELOPMENT OF COURSES/WORKSHOPS/EVENTS AND PROGRAMS

 

SPAZIO MASSAGES reserves the right to deny access to the contracted courses/workshops/events to those participants who show behavior that affects the normal functioning of the class, the forum and perform activities that violate its code of conduct, such as:

Dissemination, without proper authorization, of materials provided in the course/workshop/event or program.

The use of a personal and non-transferable user name and password by more than one person at the same time, causing clear fraud to the company.

The performance of activities that violate the intellectual property rights of SPAZIO MASAJES.

Lack of respect for people and ideas.

Lack of respect for the teacher’s authority.

Use of the class for a purpose other than that for which it was intended.

CERTIFICATE ISSUANCE

If the student/client completes the course in a satisfactory manner SPAZIO MASAJES will issue a Certificate of attendance of the course if requested by the student/client. This certificate will be sent in digital format (PDF) to the e-mail address that the student/client has indicated in the formalization of his/her enrollment/registration and registration.

 

 

RESPONSIBILITY

 

These Conditions of Sale set out all obligations and responsibilities of Spazio Massage with respect to the supply of products. There are no warranties, conditions or other terms that are binding on Spazio Massages, except those expressly mentioned in the Conditions of Sale.

Nothing in these Terms and Conditions of Sale limits or excludes the liability of Spazio Massage against

1. 1. death or personal injury caused by the negligence of Spazio Massage,
   2. the fraud
   3. any failure to comply with obligations under applicable national laws and regulations, or to comply with
   4. any liability that cannot be excluded by law.

 

APPLICABLE LAW

 

Purchases made through the Spazio Massages website and under these Terms and Conditions of Sale are subject to Spanish law.

 

EUROPEAN COMMISSION PLATFORM

The European Commission provides an online dispute resolution platform which is available at the following link: http://ec.europa.eu/consumers/odr/

 in accordance with Art. 14.1 of Regulation (EU) 524/2013.

You can only use the site if “you are a consumer resident in the EU if you have complaints about products or services purchased or contracted online from a company established in the EU,” reads the Platform’s website. It is, therefore, incompatible with conflicts generated with other countries.
